Getting a property ready for the summer rush takes more than just washing the sheets. Between strict regional laws, annual tax filings, and high guest expectations, there is a lot that can go wrong.

Capitalizing on the Summer Surge

The summer rush on the Costa del Sol is intense. During July and August, occupancy rates regularly climb to between 85% and 95%. Prices jump by 40% to 60% compared to the rest of the year. The average weekly rental across the region sits at around €1,270. In places like Marbella, the average daily rate for premium accommodation can reach €375.12.

If your property isn't listed and perfectly prepared by late spring, you are leaving thousands of euros on the table. But preparing a home for these high-paying guests from afar is incredibly difficult. You cannot just hope your property looks as good as it does in the photos. It needs deep cleaning, maintenance checks, and a reliable way to hand over keys at 2:00 AM when a guest's flight is delayed.

The Legal Reality: Decreto 31/2024

You cannot just throw your keys to a neighbor and hope for the best. The legal framework in Andalusia is strict, and the regional government actively audits rentals.

The rules changed with Decreto 31/2024, de 29 de enero (published in the Boletín Oficial de la Junta de Andalucía - BOJA No. 24 on February 2, 2024). This update officially changed the old Viviendas con Fines Turísticos (VFT) to Viviendas de Uso Turístico (VUT).

There is a major detail here that many foreign owners miss. If you hire an agency to manage your rentals, that agency must be registered in the Registro de Turismo de Andalucía as the official operating entity (explotadora). Another hurdle is your community of owners (comunidad de propietarios). If they have voted to ban holiday rentals, you cannot run one. If you host guests outside those declared periods, you are operating illegally and face heavy fines.

Streamlining Non-Resident Rental Taxes

Then there is the taxman. Every non-resident owner has to deal with Spain's tax authority (Agencia Tributaria) using Modelo 210, which is regulated under Orden EHA/3316/2010.

There is some good news here. Thanks to Orden HFP/1338/2023, de 13 de diciembre (published in the Boletín Oficial del Estado - BOE on December 15, 2023), you no longer have to file this quarterly. Starting with the 2024 tax year, it is an annual filing. You must file between January 1 and January 20 of the following year (or by January 15 if you use direct debit).

But the tax rate depends entirely on where you live:

  • EU and EEA Residents: You pay a 19% flat rate, and you can deduct operating expenses like management fees, utility bills, and community costs.
  • Non-EU Residents (including UK owners): You pay a flat 24% on your gross income, and you cannot deduct any expenses at all.

Because non-EU owners face a flat 24% tax on gross income, maximizing your nightly rates and maintaining high occupancy is the only way to protect your profit margins.
